Terms of Service

1. Acceptance of Terms

By accessing or using SwagatPMS, you agree to be bound by these Terms of Service. If you are using SwagatPMS on behalf of a hotel or organization, you represent that you have authority to bind that entity to these terms.

2. Service Description

SwagatPMS is a cloud-based hotel property management system that provides front office, finance, GST compliance, material management, and operational modules for Indian hotels. The service is provided on a subscription basis.

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Ensuring the accuracy of data entered into the system
• Compliance with applicable laws regarding guest data and tax filing

4. Subscription & Payment

SwagatPMS is billed annually per property. All fees are in Indian Rupees (INR) and exclusive of applicable GST. Payment is due at the start of each subscription period. Late payments may result in service suspension after a 15-day grace period.

5. Data Ownership

You retain full ownership of all data you enter into SwagatPMS, including guest records, financial transactions, and operational data. We do not claim any ownership rights over your content.

6. Service Availability

We target 99.9% uptime for the SwagatPMS platform. Scheduled maintenance windows will be communicated at least 48 hours in advance. We are not liable for downtime caused by factors beyond our control, including internet outages and force majeure events.

7. GST & Compliance Disclaimer

SwagatPMS provides tools to assist with GST compliance, including tax calculations, invoice generation, and GSTR export. However, we do not provide tax advisory services. You are responsible for verifying the accuracy of all tax filings and consulting with a qualified chartered accountant.

8. Limitation of Liability

SwagatPMS liability is limited to the subscription fees paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including loss of revenue or data, except where caused by our gross negligence.

9. Termination

Either party may terminate the subscription at the end of the current billing period with 30 days written notice. Upon termination, you may export your data within 90 days. After 90 days, all data will be permanently deleted.

10. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat.
